This Notice describes what RED Atlas data is, where it comes from, and the legal limits on how it may be used. It applies to all data, records, analytics, valuations, estimates, statistics, maps, reports, and other content made available by RED Atlas Inc. ("RED Atlas") through any delivery method — the RED Atlas platform, API, AI connectors, file exports, and reports (collectively, "RED Atlas Data"). Capitalized terms not defined here have the meanings in your governing terms of service.
1. Sources and Nature of the Data
RED Atlas Data is compiled from public records and governmental and quasi-governmental sources (including property registries, cadastral and tax records, and permitting systems in Puerto Rico and Colombia), recorded transactions, filings, field collection, licensed third-party sources, and RED Atlas's proprietary processing, matching, modeling, and analytics. Public records contain errors, omissions, misindexing, and reporting lags, and records are updated on varying schedules. Accordingly, RED Atlas Data may be incomplete, out of date, or inaccurate for any given property or market, and may not reflect unrecorded interests, pending transactions, physical condition, environmental matters, zoning or permitting changes, liens, or title defects. Always verify material facts against official sources — including the Puerto Rico Registry of Property (Registro de la Propiedad), the Municipal Revenue Collection Center (CRIM), the Permits Management Office (OGPe), and their Colombian counterparts (including the Superintendencia de Notariado y Registro and IGAC) — and consult qualified professionals before acting.
2. Not a Consumer Reporting Agency; No FCRA Use
RED ATLAS IS NOT A "CONSUMER REPORTING AGENCY" AND RED ATLAS DATA IS NOT A "CONSUMER REPORT" WITHIN THE MEANING OF THE U.S. FAIR CREDIT REPORTING ACT, 15 U.S.C. § 1681 ET SEQ. ("FCRA"). RED ATLAS DATA IS NOT COLLECTED, ASSEMBLED, OR EVALUATED FOR THE PURPOSE OF DETERMINING ANY CONSUMER'S ELIGIBILITY FOR ANYTHING.
YOU MAY NOT USE RED ATLAS DATA, IN WHOLE OR IN PART: (A) AS A FACTOR IN ESTABLISHING ANY PERSON'S ELIGIBILITY FOR CREDIT OR INSURANCE; (B) FOR EMPLOYMENT, PROMOTION, REASSIGNMENT, OR RETENTION PURPOSES; (C) FOR TENANT OR HOUSING SCREENING; (D) IN CONNECTION WITH ELIGIBILITY FOR ANY GOVERNMENT BENEFIT OR LICENSE; OR (E) FOR ANY OTHER PURPOSE REGULATED BY THE FCRA OR ANY SIMILAR U.S., PUERTO RICO, COLOMBIAN, OR OTHER LAW (INCLUDING COLOMBIA'S LAW 1266 OF 2008 ON HABEAS DATA AND FINANCIAL INFORMATION). BY USING RED ATLAS DATA, YOU CERTIFY THAT YOU WILL NOT USE IT FOR ANY SUCH PURPOSE.
3. Fair Housing and Anti-Discrimination
You must use RED Atlas Data in compliance with all applicable fair-housing, fair-lending, and anti-discrimination laws, including the U.S. Fair Housing Act (42 U.S.C. § 3601 et seq.), the Equal Credit Opportunity Act (15 U.S.C. § 1691 et seq.), Puerto Rico's fair-housing and civil-rights laws, and Colombia's constitutional and statutory anti-discrimination protections. You may not use RED Atlas Data — including demographic, geographic, or analytical outputs — to discriminate against any person or to implement practices such as redlining, steering, or discriminatory targeting or exclusion in housing, lending, insurance, or advertising.
4. Valuations, AVMs, and Analytics
Automated valuation model ("AVM") outputs, comparable-sales analyses, indexes, projections, and market statistics produced by RED Atlas are statistical estimates generated by algorithms and models applied to available data, without physical inspection of any property and without the exercise of appraisal judgment by a licensed or certified appraiser.
- An AVM output is not an appraisal. It is not prepared in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP) or any equivalent standard, and it is not a substitute for an appraisal by a licensed or certified appraiser, a broker price opinion, a title search, a survey, or a physical inspection.
- Where any law, regulation, or policy — including U.S. federal banking regulations and interagency appraisal guidelines — requires an appraisal or evaluation, you are responsible for obtaining one that complies.
- Actual market values and outcomes may differ materially from estimates. RED Atlas does not guarantee any estimate, and no estimate should be the sole basis for any transaction, lending, tax, insurance, or investment decision.
5. No Professional Advice; No Offer
RED Atlas Data is provided for informational purposes only. RED Atlas is not a licensed real-estate broker, appraiser, title insurer, escrow agent, law firm, accounting firm, or investment adviser, and nothing in the RED Atlas services constitutes legal, tax, accounting, investment, financial, engineering, environmental, or appraisal advice, or an offer, solicitation, or recommendation to buy, sell, lease, or finance any property or asset. You are solely responsible for your decisions and for engaging qualified, licensed professionals where appropriate.
6. Contact and Owner Information (Enterprise Module)
Owner and party contact information, enrichment, and leads ("Contact Data") are available only under an Enterprise agreement that includes the Contacts, Enrichment & Leads module, and their use is subject to the additional obligations in that agreement — including the FCRA prohibition above, marketing and telecommunications compliance (TCPA, CAN-SPAM, do-not-call and their Puerto Rico and Colombian counterparts), data-protection compliance (including Colombia's Law 1581 of 2012), suppression and deletion obligations, and a prohibition on resale or republication of Contact Data. If you have received Contact Data without such an agreement, you have no license to use it and must delete it and notify legal@atlas.red.
7. Currency and Unit Conversions
Where RED Atlas displays currency conversions (including between Colombian pesos and U.S. dollars), converted figures are indicative, based on composite or representative rates, and are not based on actual market trades; timing and source of rates may vary. See the RED Atlas Currency Data Disclaimer for details. Unit conversions (area, distance) are computed values that may reflect rounding.
8. Forward-Looking Analytics
Trend lines, forecasts, projections, and similar analytics are inherently uncertain, are based on historical data and modeling assumptions, and are not predictions or guarantees of future market behavior or property performance. Actual results may differ materially.
9. No Warranty; Changes
RED Atlas Data is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, as further set out in your governing terms of service. RED Atlas may update this Notice from time to time; the version posted at atlas.red/notices/data-use applies. Questions: legal@atlas.red.
